MISCELLANEOUS
In any action at law or in equity or in any arbitration proceeding, for declaratory relief or to enforce any of the provisions or rights or obligations under this Agreement, the unsuccessful party to such proceeding, shall pay the successful party or parties all statutorily recoverable costs, expenses and reasonable attorneys’ fees incurred by the successful party or parties including without limitation costs, expenses, and fees on any appeals and the enforcement of any award, judgment or settlement obtained, such costs, expenses and attorneys’ fees shall be included as part of the judgment. The successful party shall be that party who obtained substantially the relief or remedy sought, whether by judgment, compromise, settlement or otherwise.
【参考訳】法律上または衡平法上の訴訟、または仲裁手続きにおいて、宣言的救済を求め、または本契約に基づく条項、権利、または義務を執行する場合、当該手続きの不成立当事者は、成功当事者に、上訴および得られた裁定、判決、または和解の執行にかかる費用、経費、および手数料を含むがこれらに限定されない、成功当事者が負担したすべての法令上回復可能な費用、経費、および妥当な弁護士費用を支払うものとし、かかる費用、経費、および弁護士費用は、判決の一部として含まれるものとする。勝訴当事者とは、判決、妥協、和解、その他を問わず、求められた救済または救済措置を実質的に獲得した当事者とする。
